Terms of Service
These terms govern use of Kept ("the Service"), provided by Fergus Richards trading as Kept, a sole trader based in the United Kingdom ("we", "us"). You can contact us at [email protected]. By creating an account you agree to these terms and to our Data Processing Agreement. If you are agreeing on behalf of a business, you confirm you can bind it.

1. The Service
Kept receives pings from your automated workflows and alerts you when a workflow appears late, missing or failed, based on schedules you set or confirm. It is a monitoring and early-warning tool. It does not run, fix or guarantee your workflows.
2. Business use only
Kept is provided to businesses, sole traders and professionals for use in their trade or profession. It is not offered to consumers, and consumer protection rights (including cooling-off cancellation rights) do not apply.
3. Your account
You are responsible for keeping your sign-in email, API keys and alert channel details secure, and for everything done with them. Tell us promptly at [email protected] if you think a key has been exposed; you can regenerate keys yourself at any time.
4. Acceptable use
You must not: send Kept data your workflows process (payloads, personal records, documents) rather than metadata; put personal data in names or messages unless genuinely needed; use Kept to monitor anything unlawful; attempt to exceed rate or fair-use limits, probe or disrupt the Service, or resell it without our written agreement. We may suspend accounts that breach this section.
5. Plans, fair use and payment
- Plans and limits are shown on the pricing page. Fair-use limits (currently 600 pings per minute and 200 alert emails per day per account, 25 clients on the Free plan and 500 on paid plans, a minimum promise interval of one minute, and a limit on how often sign-in links can be requested) apply to all plans. A ping beyond a limit is acknowledged (HTTP 200) but not recorded, so Kept never interrupts your workflow.
- In addition to the per-account limits, the Service has service-wide daily caps on the number of emails it sends (every email, including alerts, digests and sign-in links) and on the number of pings it records. If a cap is reached, emails may be delayed or suppressed and pings may be acknowledged but not recorded until the next day (UTC). For security or cost reasons we may also place the Service in a temporary read-only mode, during which pings are acknowledged but not recorded and settings cannot be changed. In all of these cases alerts already raised still appear on your dashboard, and Slack, Discord and Telegram alerts are unaffected by the email cap.
- Paid plans are billed in advance, monthly or annually, by Stripe. Prices are inclusive of any applicable tax. We are not currently VAT registered; if that changes we'll give 30 days' notice.
- You can cancel any time via the billing portal. Your paid features continue until the end of the period already paid for, after which your account moves to the Free plan. Alerts for promises beyond the Free limit stop at that point. Nothing is deleted.
- If a payment fails, we'll tell you and keep your plan running for 7 days while Stripe retries. After that your account moves to Free until payment succeeds.
- Refunds: we refund in full if you ask within 14 days of a first payment. Otherwise payments are non-refundable except where the law requires.
- We may change prices with 30 days' notice by email; changes apply from your next renewal.
6. Alerts are best-effort — please read this
Kept depends on your workflows sending pings, on third-party networks and on email and messaging providers we don't control. We do not guarantee that any alert will be delivered, or delivered on time, or that every failure will be detected. Inferred schedules are proposals that you confirm; you remain responsible for checking they are right. You should not rely on Kept as your only safeguard for anything critical.
7. Your data
You own the data you send us. You grant us a licence to store and process it only to provide the Service. We store metadata, not payloads, as described in the Privacy Policy. You are responsible for what you put on any public status page you enable.
8. Availability and changes
We aim for high availability but do not promise any uptime level on these plans. We may change or withdraw features with reasonable notice. We may suspend the Service for maintenance or security reasons.
9. Liability
Nothing in these terms limits liability for death, personal injury, fraud, or anything that cannot be limited by law.
Subject to that: our total liability to you for all claims in any 12-month period is limited to the fees you paid us in that period (or £50 if you are on the Free plan). We are not liable for loss of profit, business, clients, contracts, goodwill or data, or for any indirect or consequential loss, however arising, including from a missed, late or undelivered alert.
10. Termination
You can delete your account at any time from the billing page; this is immediate and cannot be undone. We may terminate or suspend for breach of these terms, non-payment, or where required by law, with notice where practicable.
11. General
These terms are the whole agreement between us. If any part is unenforceable the rest still applies. We may update these terms; for material changes we'll email account holders 14 days ahead. English law applies and the courts of England and Wales have exclusive jurisdiction (Scottish customers may also bring claims in Scotland).
